Duterte remarks Pangilinan's juvenile justice law: "Ikaw yung abogadong alam kong pinaka-b*b* sa lahat."

President Rodrigo Duterte on his speech in Puerto Princesa on Saturday once again slammed Senator and Liberal Party President Francis "Kiko" Pangilinan for his Juvenile Justice and Welfare Act of 2006.

Duterte said that Pangilinan was the "most stupid" of lawyers for authoring Republic Act 9344 of the Juvenile Justice and Welfare Act of 2006 which  exempts young criminals from punishment even if they have committed heinous crimes.

"If you do not have anything to say except to criticize like Pangilinan, well, I'm sorry, pero shut up... ikaw yung abogadong alam kong pinaka-bobo sa lahat," Duterte said.

"Pangilinan 'yan, mag-isip lang kayo noong hindi panahon sa batas ni Pangilinan at ngayon ang nangyari," Duterte said. "Hindi mo talaga ma-detain ang bata whatever the crime may be. It could even be genocide. Walang sasagutin."

Pangilinan Law

Under Republic Act 9344, or the Juvenile Justice Welfare Act of 2006, authored by Sen. Francis “Kiko” Pangilinan, persons 15 years old and below cannot be imprisoned even for heinous crimes like rape and murder.

Based on the provisions of that law, the police and the Department of Social Welfare should first determine whether an offender 16 to 18 years of age had “discernment,” meaning the person must have known what he or she was doing during the commission of the crime.

Duterte is a 'friend' to Pangilinan

The President could not help but slammed Pangilinan for setting the minimum age of criminal responsibility at 15. The President wants to change the minimum age of criminal responsibility to as low as 9.

“The entire Philippines for the last two decades, right after the -- itong Pangilinan law, nagkalat.”

“Ngayon, walang mag-amin. Ito naman si pontifical Pangilinan, akala mo walang kasalanan kung magsalita. Siya pa 'yung presidente ng Liberal. Tignan mo, pati siya hindi manalo ‘yan,” he added.

While he had no intention of "destroying" his "friend" Pangilinan, the President could not help but be appalled by a law which allegedly allowed young criminals to run free regardless of the gravity of the offense.

Juvenile case 

Because of Pangilinan’s law, a report of three minors who beat up 21-year-old Albert Talon for no apparent reason are out scot-free.

Talon was on his way home from work in Dasmariñas, Cavite province, when he crossed the path of the three young neighborhood toughies.

The three were allegedly under the influence of drugs.

The assault was so severe Talon lost all his teeth. His jaw has been dislocated as a result of the incident.

Asked why they did it, the three said: “Kursunada lang (just for the thrill of it).”

I wonder how those legislators who approved RA 9344 would react if minors beat up their innocent relatives and then tell them the same thing.

Sought for Pangilinan's reaction, he suggested that the President needed to focus on the country's problems.

"Instead of resorting to insulting his critics it would be better if Malacañang focuses on bringing down the prices of basic goods and on going after the big time drug syndicates running circles around the BOC [Bureau of Customs] and the PDEA [Philippine Drug Enforcement Agency]," Pangilinan said.
